Hon. Thomas Drechsler (Ret.), JAMS Mediator and Arbitrator

Hon. Thomas Drechsler (Ret.) brings decades of experience as a trial lawyer and Superior Court judge to his mediation, arbitration and neutral evaluation practices. Over the course of his distinguished career, Judge Drechsler has presided over and litigated complex civil and criminal matters in state and federal courts throughout Massachusetts. Known for his thoughtful preparation, steady courtroom management and practical approach to dispute resolution, Judge Drechsler is well regarded for his ability to analyze complex factual and legal issues while fostering productive dialogue among parties. He successfully presided over a large number of judicial settlement conferences. During his tenure as a regional administrative judge, he was responsible for case management in all civil matters to encourage efficient, fair and equitable case resolutions.

Appointed to the Massachusetts Superior Court in 2014, Judge Drechsler handled a broad docket of civil and criminal cases, including business disputes, employment matters, personal injury claims, civil rights actions and felony trials. Prior to his judicial service, he maintained a long-standing civil and criminal litigation practice. Earlier in his career, he served as an assistant district attorney for approximately six years, giving him a comprehensive perspective from both the prosecution and defense sides of the courtroom.

Judge Drechsler now draws on this well-balanced experience to help parties resolve disputes efficiently and effectively through mediation, arbitration and other alternative dispute resolution processes. He is widely recognized for his proactive, hands-on approach to settlement, having consistently encouraged and engaged in meaningful resolution efforts at every stage of the proceedings during his time on the bench.

Representative Matters

Business Commercial

  • As a judge, presided over complex business and commercial disputes, including breach of contract matters involving closely held corporations; partnership disputes and dissolutions; multiparty actions alleging breach of fiduciary duty, fraud and misrepresentation; and disputes involving restrictive covenants, including noncompete and nonsolicitation agreements, as well as corporate governance and internal control issues
  • As a judge, addressed complex procedural matters, including converting motions to dismiss into motions for summary judgment and permitting supplemental evidentiary submissions for full and fair consideration of the merits

Civil Rights

  • As a judge, presided over complex civil rights matters, including claims brought under 42 U.S.C. § 1983 alleging constitutional violations by municipalities and law enforcement officers; cases involving qualified immunity and governmental liability; excessive force and civil liberties claims; and extensive dispositive and evidentiary motion practice in high-profile actions
  • As a litigator, served as counsel in civil rights disputes involving public employers, employees and municipalities, including claims of discrimination, harassment, retaliation and related constitutional and statutory violations

Construction

  • As a judge, presided over numerous construction litigation matters involving breach of contract, professional liability, infringement of property rights, subcontractor/contractor disputes, property damage and nuisance claims
  • As a judge, mediated a highly complex construction dispute involving subcontractor bond claims arising from two major bridge reconstruction projects in Boston and Gloucester; the matter involved the same parties across both projects and was resolved through settlement, avoiding two separate multi-week trials
  • As a litigator, represented a major excavation contractor in various legal matters

Criminal

  • Extensive criminal law experience as a judge, prosecutor and defense attorney, including presiding over felony jury trials, ruling on complex evidentiary and constitutional issues (including suppression motions) and managing multi-week proceedings, with particular insight into parallel civil and regulatory implications
  • As a judge, presided over complex, multi-defendant criminal matters, including homicide, motor vehicle homicide, sexual assault and organized or gang-related prosecutions, involving significant evidentiary and procedural considerations
  • As a judge, presided over matters involving charges of dissemination of harmful material to a minor and enticement of a child under 16, including post-conviction proceedings
  • As a judge, conducted pretrial detention hearings involving findings of dangerousness, requiring statutory analysis and evaluation of risk factors and evidentiary proffers

Employment Law

  • As a judge, presided over a broad range of employment disputes, including wage and hour misclassification and compensation claims; employment discrimination, harassment and retaliation matters under M.G.L. c. 151B and related federal statutes (Title VII, ADA, ADEA); wrongful termination cases involving executive-level and long-tenured employees; hostile work environment claims; workplace investigations; and disputes involving restrictive covenants, including noncompete and nonsolicitation agreements, as well as related requests for injunctive relief, in addition to issues of supervisory and management liability in claims against employers
  • As a judge, managed complex discovery disputes in employment matters, including overseeing electronic discovery issues, resolving privilege and scope disputes and extending discovery deadlines to facilitate mediation and support potential resolution
  • As a litigator, served as lead counsel in employment disputes involving discrimination, retaliation, wrongful termination, wage and hour claims and enforcement of restrictive covenants

Insurance

  • As a judge, managed complex, multiparty litigation involving layered insurance coverage, including coordination of coverage issues across primary, excess and umbrella policies
  • As a judge, presided over insurance coverage and unfair settlement practices claims under G.L. c. 176D and c. 93A, addressing issues of statutory interpretation, insurer duties, coverage determinations and allegations of bad faith
  • Served as lead trial counsel in a wide range of insurance coverage disputes, including those involving commercial general liability, professional liability, property damage, business interruption, construction defect, environmental and bad faith claims, as well as allocation, contribution and indemnification issues

Personal Injury

  • As a judge, presided over matters involving catastrophic personal injury and wrongful death claims; managed premises liability, motor vehicle negligence and other high-exposure tort actions; and oversaw expert-intensive matters involving causation and complex accident reconstruction issues, medical causation, fire/explosion causation and damages
  • As a judge, presided over numerous premises liability and negligent security matters, including claims involving liquor liability and overserving, as well as complex product liability and a wide range of personal injury disputes
  • As a judge, presided over substantial litigation involving claims of negligent and intentional infliction of emotional distress and harassment claims
  • Served as lead trial counsel for both plaintiffs and defendants in numerous premises liability and negligent security matters, including claims involving liquor liability, overservice, product liability and a broad spectrum of personal injuries
  • As a litigator, served as counsel in a dram shop liability matter before the Massachusetts Supreme Judicial Court and Superior Court involving allegations of inadequate security and the overservice of alcohol to an underage individual, resulting in catastrophic injuries, including paralysis, following a motor vehicle accident
  • Served as lead counsel in a complex, multiparty matter involving premises liability, negligent supervision and product misuse claims arising from a firearms range incident, which included a parallel criminal investigation and related insurance coverage and misrepresentation disputes

Professional Liability

  • As a judge, presided over professional liability and fiduciary duty disputes involving attorneys and other licensed professionals, including expert-driven matters alleging breaches of the applicable standard of care, as well as claims involving ethical violations and fiduciary obligations
  • As a litigator, served as counsel in a broad range of professional liability matters, including medical malpractice, legal malpractice, insurance broker and agent liability, and construction-related professional negligence claims

Real Property

  • As a judge, presided over a commercial condominium dispute involving alleged negligent maintenance of an upper unit that resulted in water intrusion, structural debris and damage to a neighboring business’s premises and inventory, including claims for negligence, nuisance and trespass, and issues relating to maintenance obligations, causation and damages within a multiunit commercial property
