An existing house and pool at 9 Wilbung Road, on the corner of Black Close, will be demolished and replaced by 2-3 storey facility with basement parking for 10 vehicles.

The development application (DA) estimated the construction cost at nearly $2 million.

The court judgment, upholding an appeal against refusal of the DA by Sutherland Shire Council, said a petition with 47 signatures and 27 separate submissions opposed the proposal.

The court hearing began with an on-site hearing, where some objectors spoke.

The judgment said various experts considered these views and all the submissions, along with contentions by the applicant, and reached substantial agreement on amendments, which were agreeable to the council.

The applicant was ordered to pay the council's costs.

The approval adds to several other childcare centres in the shire, which are in the development pipeline.
