Steve Forbes slams Governor Kathy Hochul’s (D-NY) proposal to impose a 75% tax on nicotine pouches, pointing out that doing so may encourage smokers to stick to cigarettes and cause untold deaths.

These days Americans deeply distrust politicians and public officials. This dissatisfaction was worsened by certain wrongful actions of health authorities during the Covid-19 pandemic.

New York Governor Kathy Hochul’s new budget proposal underscores why the disgust with so many of our leaders is warranted. Hochul wants to put a 75% excise tax on nicotine pouches, a popular product. The market is dominated by a pouch called ZYN. The nicotine pouches are an easy way to give up cigarettes. The dreadful harm from cigarettes and other traditional tobacco products comes from the myriad toxins and carcinogens that are inhaled when the user lights up.

Nicotine is addictive and is what gives cigarette smokers such pleasure. But in and of itself it is relatively harmless. It’s the rest of what’s in a cigarette that makes it so lethal. In Britain public health authorities advocate vaping, through which the nicotine—not the bad cigarette elements—are inhaled. They see it as a most effective tool in quitting cigarette smoking, better than patches or gum.

So why the tax attack on nicotine pouches? After all, you don’t even inhale these. A user simply puts the pouch between the lip and gum. Nonetheless, when it comes to taxing pouches as if they were cigarettes, Hochul’s budget director ignorantly declared, “We see it as a distinction without a difference.” Sure, and the moon is made of green cheese.

The budget buffoon ignored what the U.S. Food & Drug Administration (FDA) declared near the end of the Biden administration: “FDA authorizes marketing of 20 ZYN nicotine pouch products after extensive scientific review…. The FDA determined that the specific products receiving marketing authorization met the public health standard legally required by the 2009 Family Smoking Prevention and Control Act.” By the way, the approval also included 10 different flavors.

New York’s tax on nicotine pouches not only contributes to the public sector’s deepening credibility gap but also is a form of medical malpractice. Imposing a 75% excise tax on nicotine pouches on the basis that they’re like cigarettes may well discourage some smokers from switching to pouches, thereby raising the risk of such deadly tobacco-causing diseases as lung cancer.
