The TCS Nashik case points towards deeper systemic failures in workplace safeguards and compliance within the IT sector, says NITES.

Ministry of Labour and Employment has directed the Chief Labour Commissioner’s office to look into the POSH compliance of IT services companies in India following a letter by the Nascent Information Technology Employees Senate (NITES) seeking an audit of such procedures, said the IT employees union.

It said that following its complaint, it had now received an official response from the Ministry of Labour and Employment. “The Hon’ble Minister’s Office has taken cognizance of our representation and has formally forwarded the matter to the Chief Labour Commissioner’s office for immediate action.”

The communication clearly directs concerned authorities to take suitable action in the matter at the earliest and report back, which is a significant step forward, it added.

NITES sent the letter following an alleged sexual assault and coercion case in Tata Consultancy Services’ Nashik office wherein eight individuals including two women have been accused of sexually harassing and assaulting female employees and coercing them in religious pratices. However, NITES called for an inquiry of all large-cap IT companies claiming there are such failed grievances redressal systems across the sector.

“The issues highlighted in the TCS Nashik case are not isolated. They point towards deeper systemic failures in workplace safeguards and compliance within the IT sector,” said Harpreet Singh Saluja, Advocate, Bombay High Court, President, NITES.

In its letter, NITES asked the Union Labour Ministry to carry out a detailed audit of POSH compliance including, constitution, independence, and functioning of Internal Committees and the role of Human Resources personnel and senior management in handling such complaints. It also asked for an examination of all sexual harassment complaints received, pending, or disposed of across TCS establishments and a wider state-level audit of POSH compliance across IT and ITES companies operating in Maharashtra.
