Two people arrested for allegedly firing a gun at Sam Altman’s Russian Hill house Sunday have been released from jail, and their case has been put on hold pending further investigation.
Amanda Tom, 25, and Muhamad Tarik Hussein, 23 were booked on suspicion of negligent discharge of a firearm but were never charged.
A district attorney’s office spokesperson confirmed that the case is still being investigated but would not elaborate.
“Although the San Francisco police made an arrest in this case, this remains an active and ongoing investigation,” according to a statement from the district attorney’s office. “The police had probable cause to make an arrest based on the evidence gathered; however, to make appropriate charging decisions for criminal prosecution, further investigation is required.”
The office can file charges if more evidence is uncovered, but until then the case is all but closed.
According to an initial police report, a Honda sedan with two people inside stopped Sunday at 1:40 a.m. in front of Altman’s property, which stretches from Chestnut Street to Lombard Street, after passing it a few minutes before.
The person in the passenger seat put a hand out the window and appeared to fire a round on the Lombard side of the property, according to the police report, which cited surveillance footage and the compound’s security personnel, who reported hearing a gunshot.
The motorists fled, and a camera captured the car’s license plate, which led police to take possession of the vehicle, according to the report. Police later arrested the pair after searching a residence on Taylor Street.
The incident followed a firebomb attack on Altman’s home early Friday that was allegedly committed by Daniel Moreno-Gama of Texas.
SFPD Chief Derrick Lew said Monday there was no evidence linking the two incidents.

Around 3:40 a.m. Friday, Moreno-Gama allegedly threw a bottle containing a flaming rag at the metal gate of the property, according to a police report.
Security guards at the property extinguished the fire, and the incident was captured on surveillance cameras.
He was arrested hours later outside the headquarters of OpenAI.
Moreno-Gama remains in custody and has been charged with two counts of attempted murder, arson, and a long list of other state charges.
