Kyle Busch escaped a NASCAR penalty after a late crash with John Hunter Nemechek at Texas Motor Speedway, but the decision has created major debate across the NASCAR garage. NASCAR reviewed the Kyle Busch Texas crash after Busch’s No. 8 Chevrolet slammed into Nemechek’s car with two laps remaining in the Würth 400 Cup Series race on May 3. Nemechek hit the outside wall hard and failed to finish the race.

Many drivers and fans believed the contact looked intentional. Despite the reaction, NASCAR announced that no fine, suspension, or points deduction would be imposed on Busch. Officials said race data and radio communication did not prove intent.

The ruling came just days after NASCAR issued a harsh penalty to Ryan Preece during the same race weekend, leading to fresh questions about consistency in NASCAR penalty decisions.

NASCAR Explains Controversial Kyle Busch Penalty Decision

NASCAR officials said telemetry data became the key factor in the Kyle Busch penalty review after the incident at Texas Motor Speedway. On the “Hauler Talk” podcast, NASCAR Vice President of Race Communications Mike Forde explained that Sport Media Technology data showed Busch trying to control his damaged car after earlier contact from Nemechek.

Before the crash, Nemechek pushed Busch into the wall on the backstretch during the restart. Busch later moved up, entering Turn 3, and made heavy contact with Nemechek’s Toyota. The impact sent Nemechek hard into the outside wall.

Forde said NASCAR could not confirm intentional wrecking because Busch’s steering inputs showed him turning left to keep the car stable. Busch also never admitted intent over team radio.

Busch later responded on social media, sharing SMT data from the race. He wrote that he “did not start this” and said he was trying to maintain his line after the earlier contact.

Ryan Preece Penalty Creates More NASCAR Questions

The Ryan Preece penalty added even more attention to NASCAR’s handling of the Texas incidents. Ryan Preece received a $50,000 fine and lost 25 driver points after contact with Ty Gibbs during the same weekend.

According to NASCAR officials, Preece admitted over team radio that he intended to spin Gibbs. NASCAR also found evidence supporting that claim through SMT data. Officials viewed radio admission as the major difference between the Ryan Preece and Kyle Busch penalty decisions.

The NASCAR penalty dropped Preece further away from the playoff picture. Busch, meanwhile, kept all his points despite the violent Texas Motor Speedway crash involving Nemechek.

NASCAR Warns Kyle Busch After Texas Motor Speedway Crash

Even without a NASCAR penalty, officials made it clear Busch remains under close watch. Mike Forde said this marked the second recent case where Busch received “the benefit of the doubt.”

NASCAR also reviewed Busch’s earlier incident with Riley Herbst at Bristol Motor Speedway in April. Officials decided not to issue penalties in that case as well.

Forde confirmed that Cup Series Managing Director Brad Moran plans to meet Busch and Richard Childress Racing officials this week. NASCAR warned that repeated incidents could lead to stronger penalties, including points deductions or suspensions.

As the NASCAR Cup Series heads toward Watkins Glen International, the Kyle Busch penalty decision remains one of the biggest stories from Texas Motor Speedway. The next incident involving Busch could bring far heavier consequences from NASCAR.
