Negativland and their ilk typically present their work as critique of and commentary on the sampled works; that’s the point of fair use as defined, while OpenAi just plagiarized it. I don’t see a disconnect.

My problem is that Negativland seem to think that they can sample for free. As someone who writes music, I have an issue with that. IMHO if we all went along with Negativland's approach, pretty soon it's back to the badf old days of Napster.
