A Florida traveler burned his bare feet on a scorching pool deck on a Carnival Cruise ship, according to his $5 million lawsuit that claims two others have had to have their lower extremities amputated because of similar injuries.
Jorge Luis Alverio Nunez suffered the horrific burns on a quick, 20-step jaunt from the pool to his shoes on Carnival Magic’s Lido Deck, according to his Florida federal complaint.
The surface was so “dangerously hot” that “within a matter of seconds,” he’d suffered second-degree burns on the soles of his feet during the May 21, 2025, incident, claims the suit filed earlier this month.
Carnival failed to put up warning signs about the scorching hot temps of the floor despite the fact that 25 other people have been burned in the past six years on the decks of various Carnival ships — all made from API Syntheteak, a material prone to sear under the sun’s rays, the filing alleges.
In fact, Carnival knew that two people had such bad burns that their feet had to be amputated, the suit claims.
And another 42 passengers have complained about the white-hot surfaces surrounding the pools of Carnival’s fleet, the suit claims.
Nunez “suffered a severe and life changing injury to his feet … resulting in pain and suffering,” the filing claims.
He had to be hospitalized and was out of work because of the burns. He “also lost the value of the cruise and incurred other incidental expenses,” the court papers allege.
Nunez, whose cruise departed Miami, accused Carnival of failing to cool off the deck or creating shady areas.
The company could have also required passengers to wear shoes on the deck or change out the heat-absorbing material altogether, the filing alleges.
“It is reasonable for a passenger to believe they can walk safely on the pool deck when they are going to the pool,” the papers claim.
“Despite knowing that the extremely hot decks aboard its fleet disproportionately affect a vulnerable population of its cruise passengers, namely passengers with diabetes who have a significantly impaired ability to feel the hot deck and heal from wounds, defendant Carnival has taken no action to address the condition of its extremely hot decks,” the suit charges.
The suit didn’t specify whether Nunez was diabetic.
Carnival didn’t immediately return a request for comment Monday.
