The appeal was commenced against Sutherland Shire Council's deemed refusal of the development application (DA).
Sutherland Shire Local Planning Panel subsequently refused the DA in September 2025.
The court arranged a conciliation conference where the parties reached an agreement based on amended plans and documents.
The commissioner's findings included that the development was permissible and consistent with the zoning, and that exceedance of the height limit was justified.
The DA said the childcare centre on Level 1 was expected to have about 59 children and 11 staff members on site at any one time. A childcare drop-off zone would be provided at the ground floor Roberts Street frontage.
A medical centre on Level 2 would include six consulting rooms, diagnostic treatment room, nurse room, practice manager room, pathology room, clerical room, reception and waiting area; and storage.
The DA said the proposal would provides 10 commercial office tenancies across Levels 2 and 3 and four two-bedroom apartments on Level 4.
The developer was ordered to pay council costs of $25,000.
