国际刑事法院前检察官呼吁欧盟制定一项法规,禁止其所描述的“暴徒式”与“欺凌式”美国制裁,这些制裁针对法院成员,意图使法院销声匿迹。

二零二五年二月,美国实施制裁。 言于十一月,ICC之官十一人,其九为法官,一为检察官,并三 Palestinian 组织,以应 ICC 二零二四年间之决断 ,欲颁逮捕令于以色列内阁之众,其首为总理 Benjamin Netanyahu。

美之禁令,含行旅之阻、资财之冻,使法官隔绝于欧陆之金融,致其或其亲不得常生。

法图·本苏达,国际刑事法院检察官也,自2012至2021年,于海牙人权论坛之会,言曰:“此乃强权之图,欲干涉国际法所立之司法、公诉之独立行使。若国际社会不以此事为重,无机构之决断,无实践之团结,其祸将远及海牙。”

不名其国,曰:“以是器用之,向司刑者、理官者,涉法务于极恶之罪,此乃大谬于理。”

“此乃恶霸行径,失当之极,当直呼其名。变法律之争为经济胁迫,以遂政治之私。实乃恃强凌弱,以权谋术也。”

班索达责备与ICC有关之邦,反应迟缓,胆怯无为,空言支持,无实质之助,亦无抗衡之策。

今有众怒渐生,尤以荷兰政府为甚——盖因其为国际刑事法院(ICC)之主,然于保护ICC法官,使其免受沉重制裁或个人恫吓,实未尽力也。

班苏达者,冈比亚律师也,今为西非国英伦高等专员。其言曰:昔在法庭供职时,尝受有组织之恫吓,且信其后来之仕途,亦因此受影响。

复诫曰:今当为法庭本身作为机构受制裁之预备。

“吾辈当自诘以不怿之问,”彼言也。“若高才之士皆谓ICC之役,其于身家财货,有不可堪之险,则此机构之将来,将何以继?若使制裁成常,为司法之恫吓之具,则将何以处?若使银行拒其务,保险公司撤其保,技术之供者踌躇其与,外部之专士畏其牵连,则将何以应?此非虚设之论也。”

彼呼“结构之抗”,曰:“邦国诸公,于邦国之会,当立协同之律、御卫与赔偿之制,以应诸罚。邦国诸公,不可惟以忧心应之。支持之辞,非复足矣。须有实策。”

“凡依法履职之检察官、法官、书记官、调查员,不应因政治因素之制裁而倾家荡产。诸国当为法庭及其人员、授权承包商设受保护之银行与金融渠道。欧盟宜行,以启欧盟阻断法。”

复呼吁邦国“采立国之律以护,禁与强权相协,干预合法之ICC活动。罗马条约为恃,非独恃道义之固,须恃实务之固。”

荷兰政府与ICC签订协议,承诺确保对法庭不可或缺之人的安全、安全与保护,然荷兰进步派议员称联合政府于实践中未对ICC进行有效防卫,将此任委诸他国,尤以西班牙为著。

美利坚言,已制裁国际刑事法院官员,以其直接参与国际刑事法院之调查、逮捕、拘押或起诉以色列国民之事务,未得以色列之许可。

班·索达表示,美国曲解了制裁,使其从合法工具沦为不恰当的政治信号。她言道:“个人制裁之目,非惟惩戒,亦在威慑。意在生畏,意在孤立。”

彼言制裁之旨,在使国际刑事法院渐隐于无闻,复曰:“国际刑事法院非敌对政府,非武装团体,非恐怖组织,非逃避制裁者,乃关键司法机构。以制裁对司法者,乃危殆之用,其工具有本异之理。”
