英國法官不囚少年之性侵決,如「石直擊吾面」,受害者言,年十六

一法官不囚二少年,此二少年强暴二女,其一受害者称其裁决如“当吾面立一石”。

南安普敦王室法庭之审,闻二女遭强暴于汉普郡福丁布里奇,首犯在二四年十一月廿六日,次犯在二五年一月十七日,二案各异。

童子年十五,授以少年矜复之令,令其受严密之察视。其刑当由总检察长所察。

BBC之《劳拉·库恩斯伯格周日访谈》中,一受害者——事发时年十五——问曰:“使吾受此苦,其意何在?”

其家之人,隐姓名而语,女年十六,曰:"法官之决,几若云童子所为非是,然于法,因其尚幼,故亦为可也。"

Jodie Mittell KC,检方,告于庭审曰:此女于二零二四年十一月,会Snapchat之被告,后往访其一。检方言,彼时该男年十四,彼女施以淫行,及第二被告至,彼女惧而忧,二人遂辱之,而录其事。

米特尔氏言,其后,事发之视频流传于众,他人戏谑之,且有信函斥其曰“贱妇”。

正月事发之控诉者,时年十四,于福丁布里奇游乐场附近之野,遭强暴,而事亦为影片所摄。

申日之审判,一十五岁少年,因奸二女及涉淫画二事,被科三年青训令,加监禁百八十日。庭闻其已诊患ADHD与忧思。

又一十五岁少年,以对二被害者各犯强奸三罪、又因拍摄事件而涉取淫秽图像四罪,受同等之刑。庭上言其智商居“同辈之末1%”,且诊为注意力缺陷多动障碍。

又一少年,年十四,因正月间诱使第二被告共犯强奸二罪,并犯淫秽图像之罪,被处十八月青少年矫正令。其人患“认知轻障”。

尼古拉斯·羅蘭法官告諭被告曰:“吾當記,汝非稚子,非弱冠。吾當思,汝再為重罪之機率幾何,吾當確,汝勿復為重罪於後。”

釋其判詞,曰:“吾當慎,勿無故以罪責此兒,當識其行為之效,助其復歸於社稷。”

复言曰:“同侪之壓,於此事中作用甚巨。”

BBC之访谈中,女童之母向 Keir Starmer 发出呼吁曰:“若尔之女、侄女、子、侄子、家族之人,尔亦当欣然乎?”

吾等不悦,料他众亦然。尔位有权,可助,愿助之。

汉普郡警局及罪案专员唐娜·琼斯,愿助受害者家属若欲申辩于刑之宽宥.

琼斯言:“此案甚为骇人。吾深忧此辈少年,竟敢行此恐怖之事,复于网间公之于众,而竟免囹圄之罚。”

官府发言人言,司法部长衙门已得“众请”,欲依“过宽”之策,复审其刑。

发言者曰:“吾辈与民同愕此惨案之状,念及幼弱之殇,忧时伤怀。律政之吏,正亟审此案,慎之又慎。”
