A data processing addendum is an agreement that governs the processing of personal data (or personally identifiable information) between two parties and is a legal requirement for processing personal data in many countries.
We have updated our data processing addenda to comply with new or updated data protection laws around the world on the processing and transfer of personal data, and to reflect changes in law and enforcement in Europe and the United States or as otherwise required by regulatory bodies, including incorporating the new Standard Contractual Clauses issued by the European Commission, and the International Data Transfer Addendum issued by the Information Commissioner’s Office in the U.K. Please see our updated data processing addenda on our Legal page here.
Our data processing addenda have been updated to reflect changes in law and enforcement in Europe and the United States or as otherwise required by regulatory bodies. These addenda have been carefully reviewed and vetted to accurately reflect the SolarWinds position and to allow us, our customers, and our business partners to each meet our legal obligations on the processing of personal data in the future.
If you use products from SolarWinds that operate on-premises:
Yes, the Data Transfer Addendum available here will apply. For SolarWinds products used in an on-premises deployment, behind your firewall, you are in control of your own product data. By keeping your software and product data on your infrastructure, you decide how, where, and under which conditions your data is stored. To the extent that the information you choose to share with SolarWinds constitutes personal data, our Data Transfer Addendum is designed to allow both parties to comply with their legal obligations to safeguard any processing and/or transfer of that personal data.
If you purchase SaaS products from SolarWinds:
Yes, the Customer Data Processing Addendum available here will apply, unless you have entered into a Data Processing Addendum with SolarWinds after October 20, 2022. Please note that this Data Processing Addendum is tailored to the commercial off-the-shelf software we provide, to allow us and our customers to each meet our legal obligations in relation to the processing of personal data.
If you are a vendor:
Yes, the Vendor Data Processing Addendum available here will apply, unless you have entered into a Data Processing Addendum with SolarWinds after October 20, 2022. Please note that this Data Processing Addendum has been specifically reviewed and vetted to accurately reflect the SolarWinds position with respect to its vendors and to allow us and our vendors to each meet our legal obligations in relation to the processing of personal data.
These updated data processing addenda are specifically designed to allow us, our customers, and our vendors to each meet their legal obligations in order to continue to lawfully process and transfer data around the world as required to provide our products and services.
If you entered into a data processing addendum covering all of the products you purchase (or, if you are a vendor, all of the services you provide to SolarWinds) after October 20, 2022, then there is no change to your data processing terms with SolarWinds.
If you have not done so, then the applicable Data Processing Addendum will govern the processing of personal data. The applicable Data Processing Addend area is described in (5) above.
