A Cape Cod man accused of shooting and killing another patron at a restaurant in Dennis Saturday was acting in self-defense after he was stabbed in the head, according to his lawyer.
Nicholos D. Campbell, 26, is expected to be arraigned in Orleans District Court late Monday morning on charges of murder and discharging a firearm within 500 feet of a building, court records show.
Previously:
His defense attorney, Emir Sehic, said Campbell is bruised and has a staple in his head after he was stabbed during the late-night altercation at Moonfish Restaurant & Tavern on Main Street.
“This is a classic case of self-defense,” Sehic told Boston.com in a brief phone interview, noting Campbell turned himself in to police and handed over the gun he used.
Sehic confirmed Campbell has a valid license to carry, though he declined to say whether his client knew the man he’s accused of shooting. He asked that community members be patient and wait for the full story to emerge in court.
The Cape & Islands District Attorney’s Office previously said the shooting occurred around midnight Saturday, though authorities have offered few details about what allegedly occurred inside the restaurant. The DA’s office has yet to publicly identify the man killed.
In a statement posted to Facebook, restaurant owner Velma Mitchell offered her condolences to the man’s family.
“As a business owner and as a member of this community, I am saddened beyond words by the tragedy that occurred,” Mitchell wrote. “No family should ever have to experience such pain, and no words can truly ease the sorrow that comes with losing someone you love.”
She added: “I also keep everyone who has been affected by this tragedy in my prayers, including our staff, customers, and community members who are hurting and trying to make sense of what happened.”
This is a developing story and will be updated.
