Joe Biden's attorneys have been accused of trying to prevent the release of tapes which would allegedly show he revealed classified information to his ghostwriter, a conservative watchdog has claimed in court filings.
According to The Heritage Foundation, Biden's counsel have dragged their feet in the legal matter, with one of his attorneys saying her lack of response to the opposing side was because 'she had lost her voice and thus could not speak.'
The Department of Justice has threatened to release tapes that the watchdog claims will show that Biden told his ghostwriter top-secret information, the filing says.
There are allegedly tapes and written transcripts of Biden that had previously been withheld by ghostwriter Mark Zwonitzer for the president's two memoirs, 'Promises to Keep' and 'Promise Me, Dad,' joint plaintiff Mike Howell claimed.
Republicans previously filed a resolution to hold Zwonitzer in contempt of Congress in 2024 for refusing to turn over records related to the special counsel investigation into Biden's handling of classified documents.
Now, The Heritage Foundation and Howell, a Visiting Fellow in the Border Security and Immigration Center at the foundation, have filed the new lawsuit to make those documents public.
The joint status report, filed Friday in district court in Washington DC, gives Biden's legal team until May 12 to intervene - otherwise, the Department of Justice will release any available tapes on June 15.
Biden's attorneys have not been answering the plaintiffs, they claimed in the filing.

The plaintiffs say a phone call scheduled for Monday afternoon will put together a timeline on behalf of the former President, though lead counsel for Biden allegedly said they would not file a motion to intervene until after the deadline.
Speaking to The Daily Mail, Howell claimed this seemingly proves Biden has something to hide.
'The shenanigans aren't over. At the last possible second, and after every delay tactic possible, the autopen is objecting to the American People receiving transparency,' he said.
He added that the Trump DOJ will release the audio tapes if Biden does not intervene on deadline.
Republicans pointed to Biden's special counsel Robert Hur's investigation of Biden's handling of classified documents.
Hur's report noted that Biden relied 'extensively on the notebooks' notes he took during his vice presidency' in the writing of 'Promise Me, Dad.'
'Mr. Biden told Zwonitzer that some of the information in the notebook may be classified. Some of these entries remain classified up to the Top Secret level,' Hur stated in his report.
Hur's report said Biden was not consistent in how he handled classified documents, saying he seemed to sometimes have 'stopped at or skipped over the potentially classified material' when speaking with Zwonitzer and at other times Biden 'read his notes from classified meetings to Zwonitzer nearly word for word.'

Zwonitzer deleted recordings of his interviews with Biden once he learned of the special counsel investigation, according to Hur's report.
Hur testified that Zwonitzer 'slid those files into the recycle bin on his computer,' but law enforcement was eventually able to recover them. He retained the transcripts.
Biden got an $8 million book advance for the memoirs, which he said was 'more money than I ever made in my life.'
Hur accused Biden of being sloppy about sharing classified information with ghostwriter Mark Zwonitzer, who worked on Biden's first two books.
The special counsel considered charging Zwonitzer with obstruction of justice because the ghostwriter allegedly destroyed recordings of interviews he conducted with Biden while they worked on his second memoir.
Ultimately, Hur's report said Zwonitzer offered 'plausible, innocent reasons' for having done so and subsequently cooperated with investigators.
Investigators were also able to recover most of the deleted recordings from Zwonitzer’s laptop.
Republicans maintain that further review of Zwonitzer’s access to classified materials is warranted to determine if legislative reforms need to be put in place for the storage, handling and disclosure of sensitive documents by members of the Executive Branch.
Biden, in a fiery news conference after Hur's bombshell report was published in 2024, swore he had not shared classified documents.
'I did not share classified information,' Biden insisted. 'Guarantee you, I did not.' He added he wasn’t aware how the boxes containing classified documents ended up in his garage.
