A 23-year-old female DoorDash driver has been indicted in New York after her viral claims that she was sexually assaulted by a naked customer fell apart during a police investigation. 

Olivia Henderson pleaded not guilty in Oswego County Court on Friday after a grand jury decided to proceed with felony charges, according to NewsChannel 9.

Henderson faces charges of second-degree unlawful surveillance and first-degree dissemination of an unlawful surveillance image.

A plea deal is being discussed between prosecutors and the defense. If convicted on all charges, she faces up to eight years in prison, the news outlet reported. 

The former DoorDash driver was originally taken into custody on November 10 after reporting she was sexually assaulted by an unknown customer while dropping off an order on October 12 at a home in Oswego, about 45 minutes from Syracuse.

When Henderson arrived at the man's home that day to drop off the order, the front door was 'wide open,' and he was 'indecently exposed,' According to several TikTok videos posted by Henderson after the drop-off.

The DoorDasher claimed the male customer was 'sleeping on the couch within eyesight of the front door with their pants and underwear pulled down to their ankles.'

The young woman then recorded a video of the naked man and posted it on social media, which garnered more than 30 million views before being taken down.

Henderson allegedly posted a video of a nude male DoorDash customer online and claimed the man sexually assaulted her on October 12. According to Henderson, when she arrived at the man's home that day his front door was 'wide open' and he was 'indecently exposed' 

The next morning, Henderson reported she was sexually assaulted during the alleged incident, according to the Oswego Police Department.

But when authorities investigated her claim, they found no evidence of sexual assault against her, the department said.

Officers also reviewed the footage she took of the customer, who appeared 'incapacitated and unconscious on his couch due to alcohol consumption,' and determined the clip was taken from the 'exterior' of his home, police told the outlet.

Henderson was accused of 'degrading' the victim by filming 'intimate parts of such person at a place and time when such person has a reasonable expectation of privacy, without such person's knowledge or consent,' according to court documents cited by the NewsChannel 9.

She previously appeared in court in December for arraignment.

At Henderson's latest hearing, Judge Armen Nazarian did not allow cameras in the courtroom.

She declined to give a comment to reporters outside the courtroom.

When approached by the Daily Mail in November for comment, a DoorDash spokesperson referred to a statement the company made on October 16.

The delivery service confirmed Henderson took a video of the nude man and shared his 'personal details publicly.'

'No one should ever have to experience sexual assault, harassment, or abuse, and DoorDash never deactivates someone for reporting it - full stop,' the statement read.

'In this case, the Dasher let us know about an experience that made them feel unsafe - and that's exactly what we always want Dashers to do.

'However, posting a video of a customer in their home, and disclosing their personal details publicly, is a clear violation of our policies. That is the sole reason that this Dasher's account was deactivated, along with the customer's, while we investigated,' it continued.

According to NewsChannel 9, Henderson's charges allow her to remain out of prison as the case continues.

She is expected to appear back in court in June.
